Fatwa On The Allocation Of Zakat Funds For Eligible Recipients Requiring Coverage Under Protection Schemes, Takāful (Sharīʿah-Compliant Insurance) And Death-Benefit Schemes

 

RESOLUTION OF THE SPECIAL MEETING PERLIS STATE FATWA COMMITTEE

NO. 1/2026

FATWA ON THE ALLOCATION OF ZAKAT FUNDS FOR ELIGIBLE RECIPIENTS REQUIRING COVERAGE UNDER PROTECTION SCHEMES, TAKĀFUL (SHARĪʿAH-COMPLIANT INSURANCE) AND DEATH-BENEFIT SCHEMES

 

Zakat management authorities may pay takaful contributions, death benefit contributions, or contributions to Shariah-compliant protection schemes on behalf of all categories of eligible zakat recipients who require such protection. This is subject to the fulfilment of the following conditions:

1. The asnaf concerned must consent to the allocation of their entitled zakat funds for the purpose of such contributions. This encompasses both funds already in their possession and funds still held by the zakat management authority — meaning that the zakat management authority may act on their behalf in this matter.

2. The contribution must address a genuine need of the relevant eligible recipients, such as their needs in the event of an accident, death, permanent disability, or damage to property. The existence of such need shall be assessed with reference to the individual background of the eligible recipients.

3. Account must be taken of any existing provision or facility already made available by the government or other bodies, so as to avoid wasteful duplication in contributions where such needs or facilities have already been met — for instance, comparable existing facilities or other forms of protection such as government hospitals/clinics, SOCSO (PERKESO), pensions, and the like.
