Fatwa Concerning The Involvement Of Muslim Contractors Or Workers In The Construction Of Non-Muslim Crematoria

FATWA CONCERNING THE INVOLVEMENT OF MUSLIM CONTRACTORS OR WORKERS IN THE CONSTRUCTION OF NON-MUSLIM CREMATORIA
1. A Muslim is prohibited from recognizing disbelief and transgression. Consequently, a Muslim must not be directly involved in strengthening matters of disbelief and transgression.
2. However, under specific circumstances, a Muslim may be involved in the administration of matters involving disbelief and iniquity if there exists a necessity, subject to certain conditions:
a. If executing duties directed by the governing authority for the purposes of security and regulatory implementation, such as security personnel safeguarding non-Muslim religious celebrations, engineers, project supervision duties for houses of worship, healthcare workers and the like.
b. Not being directly involved in any religious ceremonies or emulation of the practices of disbelievers. This includes glorifying the symbols of other religions or performing the rituals of other religions.
c. Not giving rise to suspicion and negative assumptions regarding the creed (aqidah) of the individual involved.
3. As for managing the affairs of non-Muslims that do not contravene Islamic teachings and are not symbols of their religious rites, such as managing their deceased (shrouding or burying them) and providing transport to the cemetery if there is a necessity, treating priests and clergy medically, extinguishing fires at houses of worship—these are permissible.
4. A Muslim must not engage in any business that directly contravenes the Shariah or promotes the symbols of religions that contradict Islam, such as constructing or supplying implements of worship.
5. Muslims acknowledge the right of adherents of other religions to exist and practice their religions in compliance with the legal regulations established by the governing authority.
