THE 56TH MEETING OF THE PERLIS STATE FATWA COMMITTEE / 2022

11 - 12 MAC 2022 / 8 - 9 SYA'BAN 1443H

THE RULING ON BUYING AND SELLING WITHIN THE MOSQUE

A mosque is a building that has been endowed (waqf) or permanently designated for the Muslim community to perform the five daily congregational prayers and other acts of worship. Any building that is constructed, even if adjacent to or connected with the mosque or within the mosque compound's fence, but is not designated or endowed for the purpose of the five daily congregational prayers and worship, is not considered part of the mosque. The ruling on buying and selling within the mosque is as follows:

1. Deliberately making or using the mosque as a venue for buying and selling, even in minimal quantities, is prohibited based on the consensus (ittifaq) of Islamic scholars.

2. Business transactions or sales campaigns within the mosque that occur without any intention of turning the mosque into a place of commerce—scholars hold differing views regarding this matter. The conclusion is as follows:

a) If such activities disturb the atmosphere of worship within the mosque, whether through noisy commotion or the condition of goods brought in, it is prohibited.

b) If it occurs incidentally without the intention of making the mosque a place of trade and does not disturb the atmosphere of worship, it is reprehensible.

c) If online transactions occur without manifesting any atmosphere of trade within the mosque, it is reprehensible.
