THE STATUS OF KHULUK: WHETHER IT CONSTITUTES DIVORCE (ṬALĀQ) OR ANNULMENT (FASAKH)

 

The dissolution of marriage through the method of khuluk has given rise to a difference of opinion among scholars as to whether it is to be regarded as a divorce or an annulment. A number of countries have classified it as a divorce, among them Indonesia, Jordan, and Egypt, whilst others, such as Saudi Arabia and Qatar, have classified it as an annulment.

The dissolution of marriage through the method of khuluk is ruled as an annulment. This means that it is not counted among the prior number of divorce pronouncements previously issued by the husband, if any, and the wife is required to observe a waiting period ('iddah) of one menstrual cycle only.
