Ruling On The Number Of Divorces For A Woman Remarried After A Previous Marriage To Another Husband

THE 71ST MEETING OF THE PERLIS STATE FATWA COMMITTEE / 2024
6 - 7 DECEMBER 2024 / 4 - 5 JAMADIL AKHIR 1446H
RULING ON THE NUMBER OF DIVORCES FOR A WOMAN REMARRIED AFTER A PREVIOUS MARRIAGE TO ANOTHER HUSBAND
A woman who has been divorced by her husband, then marries another man and consummates that marriage, and is subsequently divorced from or widowed by that second husband, may remarry her former husband. In this case, the previous number of divorces between her and the first husband is annulled (al‑ḥadhm). This applies regardless of whether the prior divorces were one, two, or three; none of them are taken into account for the new marriage.
If the woman does not marry another man after her divorce and then remarries her former husband, the remaining number of divorces from the previous marriage remains in effect.
