Ruling On Revoking A Conditional Divorce

RULING ON REVOKING A CONDITIONAL DIVORCE

 

A conditional divorce with the intention of divorce for a matter that has already occurred cannot be revoked because the divorce has already taken effect.

As for a conditional divorce with the intention of divorce for a matter that has not yet occurred, such conditional divorce may be revoked, and the revocation must be communicated to the wife or her trustworthy representative. At the same time, it is recommended that the religious authorities impose ta'zīr (discretionary punishment) punishment for misusing sharī'ah provisions.

By virtue of this fatwa, the previous fatwa decision dated 2 December 1999 (entitled: “Do all types of conditional divorce effect a divorce, and can they be revoked?”), which held that a conditional divorce could not be revoked, is no longer applied.
