FATWA ON MARRIAGE CONTRACT VIA LIVE VIDEO CONFERENCE
Marriage solemnization through live video conferencing is valid if the parties involved are certain that the pillars (rukun) of marriage and its conditions have been fulfilled and it is free from any element of deception.
As for the registration of marriage in Perlis, it is subject to the Perlis State Islamic Family Enactment and verification from the Perlis Islamic Religious Affairs Department.
To prevent any element of deception, the registrar shall not register a video conferencing marriage unless it is also witnessed by a representative of the registrar or possesses documentation recognized by the registrar.
The Perlis State Fatwa Committee advises prioritizing physical presence for as it is closer to the original nature of marriage and avoids confusion and dispute, unless there is a necessity to conduct it through live video conferencing.
Endorsed at the Meeting of the Perlis Islamic Religious Council and Malay Customs (Majlis Agama Islam dan Adat Istiadat Melayu Perlis) Bil. 2/2020 on 30 June 2020.
